Information about our legal IT consulting services, compliance requirements, and client agreements for Swiss businesses

1. General Terms

These Terms of Service govern the legal relationship between TechLawZone and our clients for all legal IT consulting, compliance, and technology law services. By engaging our services, you agree to these terms and conditions.

Scope: These terms apply to all services provided by TechLawZone, including legal IT consulting, compliance assessments, cybersecurity advice, data protection guidance, and related technology law services. Any deviations from these terms must be agreed upon in writing.

2. Service Scope

TechLawZone provides comprehensive legal IT consulting services for businesses seeking expert guidance on technology law, compliance, and cybersecurity matters. Our service range includes:

  • Legal IT Consulting: Expert advice on technology law, software licensing, and IT contracts
  • Compliance Assessments: GDPR, Swiss data protection, and industry-specific compliance reviews
  • Cybersecurity Guidance: Legal frameworks for data security, incident response, and risk management
  • Data Protection Services: Privacy impact assessments, data processing agreements, and policy development
  • Technology Contracts: Software licensing, SaaS agreements, and IT service contracts
  • Regulatory Compliance: Swiss and EU technology regulations, industry standards, and best practices

The specific scope of services will be determined in individual client agreements. Additional services will be arranged and billed separately.

3. Client Obligations

For proper delivery of our legal IT services, our clients are required to:

  • Complete Business Information: Provide all relevant company details, IT infrastructure information, and compliance requirements
  • Service Compliance: Adhere to our service policies and professional guidelines
  • Accurate Information: All information provided must be correct, complete, and up-to-date
  • Cooperation: Active participation in legal assessments, compliance reviews, and service delivery
  • Timely Payment: Settlement of invoices within agreed payment terms
  • Confidentiality: Maintain confidentiality of our legal advice and proprietary methodologies

Incomplete or inaccurate information may result in additional legal assessments that will be charged to the client.

4. Fees and Payment Terms

Legal IT consulting fees are based on service type and complexity according to individual client agreements.

  • Consulting Rates: Standard consultation CHF 350/hour, Compliance assessment CHF 2,500/project, Contract review CHF 1,800/document
  • Additional Services: Expert witness testimony, litigation support, and specialized compliance audits billed separately
  • Payment Terms: Invoices due within 30 days of issue
  • Late Fees: 1.5% per month on overdue balances
  • Additional Costs: Travel expenses, court filings, and third-party expert consultations billed separately

5. Liability and Warranty

TechLawZone provides all legal IT services with the utmost care and according to recognized principles of Swiss legal excellence.

Liability Limitation: Liability is limited to gross negligence and willful misconduct. The amount of liability is limited to three times the annual service fees, but not exceeding CHF 150,000.

Warranty: Defective services will be corrected at no charge if they are due to TechLawZone's fault. Further claims are excluded.

6. Confidentiality and Client Information

TechLawZone commits to strict confidentiality of all client information and business data:

  • Professional Confidentiality: All employees are bound by attorney-client privilege and confidentiality obligations
  • Data Protection: Client information handled according to Swiss privacy laws and GDPR
  • Data Security: Technical and organizational measures to protect client data
  • Record Retention: Client records maintained according to legal requirements (minimum 7 years)

7. Termination and Service Ending

Service relationships may be terminated by either party with proper notice:

  • Notice Period: 30 days written notice for ongoing service contracts
  • Immediate Termination: Possible for important cause or legal conflicts
  • Service Transition: Assistance with service transfer after full payment of all invoices
  • Record Retention: Client records retained for 7 years, then destroyed

8. Final Provisions

Applicable Law: These terms are governed by the laws of Switzerland.

Jurisdiction: Exclusive jurisdiction is Interlaken, Switzerland.

Amendments: Changes to these terms require written form. If individual provisions become invalid, the remainder of the contract remains valid.

Effective Date: These terms take effect on January 1, 2025, and replace all previous versions.

9. Refund Policy

At TechLawZone, we understand that circumstances may require changes to service arrangements. Our refund policy ensures fairness while maintaining the high standards of our legal IT consulting services:

Consulting Service Refunds:

  • Cancellation with 60+ days notice: Full refund of prepaid consulting fees minus a 5% administrative fee
  • Cancellation with 30-59 days notice: 90% refund of prepaid consulting fees
  • Cancellation with 14-29 days notice: 75% refund of prepaid consulting fees
  • Cancellation with 7-13 days notice: 50% refund of prepaid consulting fees
  • Cancellation with less than 7 days notice: 25% refund of prepaid consulting fees

Special Circumstances: In cases of documented business emergencies, legal conflicts, or other extraordinary circumstances, special consideration may be given for partial or full refunds at management discretion. All refund requests must be submitted in writing with appropriate documentation.
